Vision FM: Court Adjourns Forceful Entry, Intimidation Suit To March 1

A Kaduna State High Court 13 has adjourned a suit on forceful entry and intimidation filed by the Vision Media Service Limited and the CEO Umar Faruk Musa against a business mogul, Mahadi Shehu, to March 1.

Daily Trust reports that the media outlet and Shehu have been at loggerheads since he destroyed its station on College Road in Unguwan Dosa, Kaduna North Local Government Area of the state.

When the case, with suit no. KDH/HC/2021came up for hearing yesterday, the presiding judge, Justice Edward Andow, adjourned the matter for further hearing.

The plaintiffs in their originating summons are seeking the following reliefs: A declaration that having validly permitted the Defendant/Landlord to occupy House No.1 College Road, Unguwan Dosa, Kaduna, free of rent since 2019, and the plaintiffs are qualified to be regarded as licensees under section 3 of the Kaduna State Landlord and Tenant Law, 2018.

“A declaration that being a landlord/owner, the defendant is bound to follow due process in recovering possession of the house No.1 College Road, Unguwan Dosa, Kaduna occupied by the Plaintiffs as licensees.

“A declaration that the unilateral action taken by the Defendant/Landlord by forceful entry and disconnection of electric and water supply of the House No.1 College Road, Unguwan Dosa, Kaduna, occupied by the plaintiffs as licensees to operate a radio station in an attempt to recover possession is an act of intimidation and self-help which is illegal, unlawful and contrary to Section 29 of the Kaduna State Landlord and Tenant Law, 2018.

“A declaration that the unilateral action taken by the Defendant/Landlord by forceful entry and removal of gate entrance, roofing, ceiling, doors and windows of the House No.1 College Road, Unguwan Dosa, Kaduna, occupied by the plaintiffs as licensees to operate a radio station in an attempt to recover possession is an act of intimidation and self -help which is illegal, unlawful and contrary to section 29 of the Kaduna State Landlord and Tenant Law, 2018.

“An order directing the defendant to pay the sum of N10million as general and exemplary damages for subjecting the plaintiffs to humiliation, inconvenience, intimidation and disruption of the activities of their radio station by means of self-help.”

Ayefele establishes Another Radio Station, Blast FM In Ibadan
